Would download the latest version for Apple Silicon. NI calls it the version for Mac M1/M2 at some points but it works fine on my M3 Max MacBook.

it didn't work, its telling me to downgrade to rosetta

Nothing of that sort. The underlying driver (NTKDaemon) needs Rosetta to function. Native Access app itself is Apple Silicon native.
It just tells you to install Rosetta compatibility layer for NTKDaemon, which you do once and then you can forget about its existence (Rosetta, not NTKDaemon).

At which point? Have the Apple Silicon version on my machines and it is working flawless so far. Or does it prompt you to install Rosetta? I am not sure if all modules coming with Native Access are Apple Silicon yet.
But have installed Rosetta on my Macs anyway.

That's why it didn't prompt you. If Rosetta was installed - there was no need. NTKDaemon needs Rosetta to function.
